MAGIC 92.5 (XHRM-FM) & LOCAL MEDIA SAN DIEGO, LLC ARE NOT RESPONSIBLE FOR ANY EVENT / PRIZE CHANGES AND / OR CANCELLATIONS.

General contest rules may be picked up at 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121, Monday – Friday during normal business hours.

Local Media San Diego, LLC, its subsidiaries and affiliated companies (together, the “Company”), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows.

NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of participants.

1. Description.

A. On-Air Contest

Dates: April 15, 2024 to May 17, 2024.

How to Play: Listen for the designated cue to call (“Song of the Day”) and be caller 92 to 888-537-1925. 

How Winner is Chosen: The successful caller will be declared winner, following confirmation of eligibility.

B. On-line Sweepstakes at www.magic925.com

Dates: April 12, 2024 to May 14, 2024.

How to Play: Enter in the designated field(s).

How Winner is Chosen: On April 16, 23, 30, May 7 and 14, one contestant will be selected at random from successful entries received and declared winner, following confirmation of eligibility.

ALL DECISIONS MADE BY JUDGES ARE FINAL.

2. Prize(s):

Prizes that may be awarded to an eligible winner is four (4) 1-Day, 1-Park tickets for admission to Disneyland® Park or Disney California Adventure® Park (the “Tickets”)(subject to restrictions).  The approximate retail value (“ARV”) of each Ticket is one hundred seventy nine dollars ($194.00); set of four (4) Tickets is seven hundred sixteen dollars ($776.00).

Winners are strongly advised to seek professional legal, tax advice. Award of the Prize could have material adverse consequences on the winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.

Prizes are not transferable or exchangeable for any other prize, and must be accepted in whole. If a winner cannot be contacted or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

3. Eligibility and Limitations.
Participants, contestants and winner(s) must be U.S. residents of San Diego County, at least 18-years old as determined by the Company, have an active social security number, and be able to present California ID to contest officials before the prize is awarded, as well as the original social security card if needed.

Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

4. Taxes.
Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes, including the vehicle sales tax and registration. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize unless otherwise noted. Any person winning over $600 in prizes from a station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. Winner agrees to accept the prize “as is.”

5. Publicity; Use of Personal Information.
By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.

6. Affidavit.
Winners may be required to sign and return an Affidavit of Eligibility, Release of Publicity, and Release of Liability upon notification of winning. Failure to sign and return the affidavit and release within such period or to comply with any term or condition of these Official Rules may result in disqualification and forfeiture of any interest in a prize.

7. Release.
By participating, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.

The company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email, technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer or data related to or resulting from participating or downloading materials in this Web site or Contest. The company is not responsible for cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the Contest, or to defraud the Sponsor in any way, may be prosecuted to the fullest extent of the law. Participants engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Contest is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the company reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest and award prizes among eligible entries received.

8. Decisions.
By participating in the Contest, participants agree to be bound by the decisions of Company personnel. The Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Company believes has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion.

9. Miscellaneous.
Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize.  No purchase necessary to participate or win.  Purchase does not increase chance of winning.  Odds of winning depend upon the number of participants.  The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s).  The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.  

Theme park tickets must be used prior to June 15, 2025. Terms and conditions as set forth herein and on the theme park tickets shall apply. Theme park tickets may not be sold, transferred for commercial use, exchanged, substituted, or redeemed for cash. No substitutions. An inability to use any tickets will result in forfeiture of such tickets. Block-out dates may apply. No extensions will be granted.

Both a theme park ticket and a separate theme park reservation for the same park on the same date are required for park entry for the winner and each Guest. Theme park reservations and tickets will be required for each day of the visit and must be obtained before visiting. Park reservations are limited, subject to availability and not guaranteed. Park reservations do not guarantee park admission or access to any experience, attraction, or offering. Winner and Guests should visit Disneyland.com/updates to make park reservations and to learn about important details to know before visiting the Disneyland Resort.

Prize will not include the following: transportation to/from the Premises; insurance (health, travel, medical); parking fees; hotel accommodations; food or beverages; merchandise, souvenirs; incidental expenses; local or long distance telephone calls; tips, gratuities, service charges; any taxes; or any other charges or items not explicitly included herein.

Certain theme parks, hotels, restaurants, attractions, experiences, services and other offerings are subject to change or cancellation, and may be modified, limited in availability or capacity, or be closed. Park admission and offerings are not guaranteed. Disney reserves the right to cancel any reservations or admission media.

A winner may not charge any Guest for participating in the prize. Prizes are awarded “as is” with no warranty or guarantee, expressed or implied, being provided by Promoter or Disney.

Any damaged, lost or stolen theme park tickets will not be replaced.

Federal, state and local taxes relating to the prize are the responsibility of the winner and Promoter will issue all tax forms including a 1099 form to the winner.

Promoter is the sponsor of the Sweepstakes.

Disney, its parent, related, affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns will be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize, the receipt, use and/or enjoyment of the prize, or prize-related activity including travel.

An inherent risk of exposure to COVID-19 exists in any public place where people are present. By accepting and using the prize and visiting the Premises, the winner and guests voluntarily assume all risks related in any way to exposure to COVID-19, and any other communicable or infectious disease. The winner and guests must comply with all theme park rules and regulations, including any public health restrictions. Failure to do so may result in forfeiture of such portion(s) of the prize. Disney reserves the right to remove or deny entry to the winner and/or any of the guests who do not comply with any health restrictions imposed by any government, or Disney. The winner and guests are also responsible for understanding and complying with any COVID-19 travel restrictions. Before visiting, each guest should visit Disneyland.com/Updates to view important information about park reservations, limitations on benefits, features, experiences and offerings, safety measures and other information. There may be specific state or government health agency instructions, guidelines and requirements for all visitors to the Premises. The winner and their Guests are solely responsible, at their own cost, for staying updated on and complying with any of the latest restrictions and requirements that may be in place for travel to and visiting the Premises.

All disputes arising out of or relating to any prize provided by Disney shall be resolved by applying the laws of California, without regard to conflict of law rules, and shall be solely and exclusively brought in state or federal courts within Orange County, California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail and govern.

10. Winner’s List.
For a Winner’s List, available thirty (30) days following the end of the Contest Period, send a self-addressed, stamped envelope to: Local Media San Diego, Attn: MAGIC 92.5 Disneyland Winners Pixar Fest 2024, 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121. Please include the following in your Winner’s List request: Your full legal name, name of station and indicate which winner’s list you would like to receive. Please include one self-addressed, outer postmarked envelope for every list requested.

11. Compliance with Law.
The conduct of the Contest is governed by applicable federal, state and local laws and regulations. Participation in this Contest is void where prohibited or otherwise restricted by law. Written copies of these rules are available during normal business hours at the business offices of the Station and by mail upon written request with a stamped, self-addressed return envelope.
