SoCal Taco Fest “GUAC-OFF” Contest Terms and Conditions

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR RECEIVE A PRIZE. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF RECEIVING A PRIZE. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW. THIS CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW.

DESCRIPTION: The SoCal Taco Fest Guac Off Contest (the “Contest”) allows one (1) Eligible Person (defined below) to win the Grand Prize consisting of a $400 Grocery Outlet gift card (the “Card”), a cookbook, and an apron. Additionally, one (1) Second Place winner will receive a $200 Grocery Outlet gift card, a cookbook, and an apron, and one (1) Third Place winner will receive a $100 Grocery Outlet gift card, a cookbook, and an apron. A total of four (4) participants will be selected among eligible entries to receive two (2) general admission tickets to SoCal Taco Fest on August 17, 2024 at Waterfront Park in San Diego, and compete for the Grand Prize.

By participating in the Contest, each individual agrees to comply with and abide by these terms and conditions (“Terms”) and the decisions of SoCal Taco Fest, located at 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121 (“Sponsor”), which shall be final and binding in all respects.

ELIGIBILITY: Open to legal residents of California who are at least twenty-one (21) years or older at the time of the Contest (“Eligible Person”). Employees, contractors, agents, directors, and officers of Sponsor and each of its parent, subsidiaries and affiliates, distributors, sales representatives, retailers, advertising, and companies involved in the implementation and execution of the Contest (collectively, “Contest Entities”) and each of their respective immediate family members (i.e., spouse, parent, child, sibling and the “steps” of each) and persons living in the same household of each are not eligible to participate. Void where prohibited or restricted by law. By participating in this Contest, an individual who meets the eligibility requirements and participates agrees to be bound by these Terms and agrees that the decisions of Sponsor shall be final and binding in all matters pertaining to the Contest. All federal, state and local laws and regulations apply.

CONTEST PERIOD: The Contest begins on July 31, 2024 at the website SoCalTacoFest.com until August 13, 2024 at the close of night evening, 11:59pm (“Contest Period”).

HOW TO PARTICIPATE IN THE CONTEST: To participate in this contest, individuals must adhere to the following steps:

PARTICIPANT SELECTION:

  • Fill out all contact information on the designated entry form at SoCalTacoFest.com
  • List ingredients for your personal guacamole recipe on the designated entry form.

LIMIT: ONE (1) ENTRY PER ELIGIBLE PERSON.

At the end of the contest period, four (4) entries will be selected as Guac-Off Participants. Guac-Off Participants will have an opportunity to prepare and present their guacamole recipe to judges on-site at SoCal Taco Fest and win the Grand Prize, Second Place or Third Place prizes, subject to the Rules and Regulations on EXHIBIT 1.

No purchase necessary. Purchase will not increase chances of winning. While supplies last. Winners will be contact at phone number and e-mail address provided.

PRIZE REDEMPTION AND ODDS: Odds of winning depend upon the number of Eligible Persons to participate. If any potential Prize recipient is found to be ineligible, or if they have not complied with these Terms or decline the Prize for any reason prior to award, such Prize will be forfeited and may be awarded to an alternate recipient.

All costs and expenses not set forth as part of the Prize shall be the sole responsibility of each Prize recipient. 

APPROXIMATE RETAIL VALUES (ARV):  Total approximate retail value of all Prizes: $1092.00 [ARV].

GENERAL: Failure to provide any requested information to verify eligibility, and/or non-compliance with these Terms may result in forfeiture of the Prize and an alternate recipient may receive the Prize.

No cash equivalents, substitutions or transfer of the Prize is permitted, except in Sponsor’s sole discretion. If a Prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute Prize with another item of equal or greater value. Acceptance of a Prize shall be construed as and signify the recipient’s agreement and consent that Sponsor may use the recipient’s name, portrait, picture, biographical information, voice, likeness, statements, photograph and/or Prize information, without limitation, for promotional purposes in any and all media now known or developed in the future, throughout the world in perpetuity without further consideration, review, approval or payment, unless prohibited by law.

By participating, recipient agree to hold harmless the Contest Entities, and their respective parent companies, affiliates, directors, employees, officers and agents from any and all liability, injury, loss or damage of any kind, including but not limited to personal injury or death, arising from or in connection with participation in the Contest, or the awarding, receipt, possession, use or misuse of any Prize and/or with respect to participation in any Contest-related activity. Sponsor is not responsible for any typographical or other error in printing, offering, announcement or administration of the Contest. By participating in this Contest, the individual agrees to be bound by the Terms and Conditions and the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right, in its sole discretion to cancel or suspend this Contest should fraud, or other causes beyond the control of Sponsor corrupt the administration, security or proper administration of the Contest. CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATIONS AND RELEASES: Sponsor is not responsible for: (a) any incorrect or inaccurate information, whether caused by the individuals, printing errors, or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing; or I any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from individual’s participation in the Contest or receipt or use or misuse of any Prize. No more than the stated number of Prizes will be awarded. Caution: Any attempt by any person to deliberately damage any associated website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law. Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the process.

DISPUTES: By entering the Contest, Eligible Person agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate California State Court located in San Diego County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Eligible Person be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Eligible Person and Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the state of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Entrants agree that the statute of limitations for asserting any claims shall be a period of one (1) year from the time the cause of action accrued, or the cause of action shall be forever barred.

PRIVACY: Any personally identifiable information collected during an Eligible Person’s participation in the Contest may be collected by Sponsor or its designee and used by Sponsor, its affiliates, designees, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and in accordance with Sponsor’s Privacy Policy as stated at https://www.socaltacofest.com/privacy-policy/

PUBLICITY: Acceptance of a Prize constitutes a winner’s consent to Sponsor’s and its agents’ use of the winner’s name, city, state, likeness, photograph, and/or voice for promotional, advertising, or other purposes, worldwide, in any and all media now known or hereinafter developed, without limitation and without payment, notification, permission or other consideration, except where prohibited by law.

TAXES: Sponsor makes no representations about the tax consequences of being selected as the winner and receiving a Prize. No part of the Prize or its equivalent cash value will be subject to withholding by Sponsor for the payment of any taxes. Sponsor will report amounts received by an Eligible Person who is chosen to be a winner and receives a Prize by filing Form 1099 with the Internal Revenue Service as required by law. Winner must provide the Sponsor with valid identification and a signed IRS Form W-9 before the Prize will be awarded. By participating in this Contest, Eligible Person agree that they will be solely responsible for all (i) all applicable federal, state, and/or local taxes, and for any fees or costs associated with the Prize awarded, and (ii) reporting and paying any and all applicable taxes. You must contact your own tax advisor for any questions concerning taxes.

EXHIBIT 1

GUAC OFF 2024: RULES AND REGULATIONS

SoCal Taco Fest will provide the following ingredients from Grocery Outlet and equipment to be used to prepare and serve your guacamole:

– 5 Avocados from Peru, 2 Limes, 1 White Onion, 1 Red Onion, 2 Roma
Tomatoes, Cilantro, Garlic, Chips, Salt and Pepper

– Bowl, Knife, Fork, Spoon, Cutting Surface, Food Prep Gloves, Apron, Food Boats for submitting your creation to the judges, and napkins.

You are allowed to bring up to 12 additional food ingredients (inclusive of spices) to personalize your guac creation.  They may be prepped in advance for ease of assembly on site at the festival.

You are not allowed to bring any kitchen equipment or utensils.  No cooking equipment (stove/oven/etc.) will be available.

You will have up to 30 minutes to make your Guacamole – If you do not finish your plated submission within the time allotment, you will be docked 5 points on your final score.

Judging Criteria

You are required to prepare and serve one “taste” size portion (roughly ⅛ cup), accompanied by the provided chips, for each judge.  There will be three judges total.

Judges will score each dish based on taste, creativity and visual appeal.  These criteria are worth 10 points each for a total of 30 available points which will be tallied to determine your score.

The contestant with the highest score will win the competition and be awarded the grand prize.  The judges will also choose 2nd and 3rd place winners and they will receive one consolation prize each.

In the case of a tie, the winner will be determined by the head judge

All decisions are final and at the discretion of the judges.

This is a fun-spirited competition that should be taken lightly.  So, come ready to bring your skills and have a good time!

Prizes

All participants will receive an apron to wear on stage, goodie bag, and cookbook.

1st prize will receive $400 Grocery Outlet gift card, trophy award.

2nd prize will receive $200 Grocery Outlet gift card

3rd prize will receive $100 Grocery Outlet gift card
